Bankruptcy Property Information Form
This form tells Gia Freer, Broker of Record at PBP Real Estate, about a house or condo in a bankruptcy case. It takes about two minutes. Homeowners, bankruptcy attorneys and trustees' offices can all use it. Gia reviews every submission personally, replies within one business day and keeps it confidential.
Key takeaways
- Share what you know: the property, your role, the chapter, and your attorney or trustee if you have one. Missing answers are fine.
- Never send a Social Security number, account numbers or how much you owe. We do not need them and do not ask for them.
- Submitting the form creates no obligation. It is not legal or tax advice; the bankruptcy case stays with your attorney.
What happens after you send the form?
Gia reads it, and if you allow it, speaks with your bankruptcy attorney first. She then prepares a written opinion of value by hand from current Beaches MLS closings, so you and your attorney have a documented figure before any decision about selling. If a sale goes ahead, we coordinate the listing and the contract with your attorney and the trustee so they match the court's timeline. On a trustee's sale, we start only after the court approves our employment.
Is what I send kept confidential?
Yes. Florida law treats a seller's reason for selling as confidential unless the seller waives it in writing (section 475.278, Florida Statutes). Your submission goes to Gia only. It is never used in marketing, and nothing you tell us about the case appears on any listing. We never pay attorneys or trustees for referrals.
Background reading first? The bankruptcy home-sale hub covers each chapter, the flowchart shows the steps in order, and the page for trustees and attorneys explains how we work with counsel. To see how we price, read how we price a home.
This page is general information from a licensed Florida real estate brokerage acting as a transaction broker; it is not legal or tax advice. Ask your bankruptcy attorney about your case.
