For Bankruptcy Trustees and Attorneys: Court-Approved Home Sales in South Florida
PBP Real Estate lists and sells real property in Chapter 7, 11 and 13 cases across Miami-Dade, Broward, Palm Beach, Martin and St. Lucie. We supply our own Rule 2014 statement, the listing terms, the executed contract, a dated offers log and a written opinion of value prepared by hand. We do not prepare court papers, and we never pay attorneys or trustees for referrals.
Key takeaways
- Estate listings start only after the employment order (11 U.S.C. 327(a), 328, 330; Fed. R. Bankr. P. 2014).
- Before accepting a file we check our records for any connection to the debtor, creditors or the buyer, and disclose what we find.
- The commission is paid at closing as approved by the court.
- Gia Freer, Broker of Record, handles every file personally, in English or Spanish.
- Gia and Grant Freer have closed 767 transactions and $203,762,527 since 2000, 671 of them since 2013 (Beaches MLS, agent production report, as of October 19, 2026).
Informational purposes only. Nothing on this page is legal or tax advice. PBP Real Estate, LLC is a licensed Florida real estate brokerage (License CQ1064615), not a law firm. We do not prepare motions, applications, schedules, plans or proposed orders, and we do not advise debtors on their cases.
What do you supply for an employment application?
Our own statement and our listing terms, ready for counsel to file. When a Chapter 7 trustee or a Chapter 11 debtor in possession wants to employ us, counsel prepares the application; we supply what only the broker can.
- A Rule 2014 verified statement of our connections with the debtor, creditors, the U.S. Trustee's office and other parties, after a conflict check of our transaction and contact records.
- The proposed listing agreement, with the commission, the listing term and the court-approval language counsel provides.
- A short marketing plan and timeline for the property, so the court sees how and for how long the property will be exposed to buyers.
We do not market the property, and we do not incur costs we would ask the estate to repay, until the employment order is entered.
What do you supply for a sale motion?
The documents that show the price is the best the market offered. Southern District of Florida Local Rule 6004-1 asks for the purchase agreement and a proposed order, with the buyer, price, terms and insider status disclosed. The motion and the order are counsel's; these are ours:
| Document | What it shows the court |
|---|---|
| Executed contract with a court-approval contingency | The buyer, price, terms and closing timeline; contingency wording from counsel |
| Offers log | Every offer with its date, price, terms and financing, including those declined |
| Marketing record | Days on market, Beaches MLS exposure, showings and price changes |
| Written opinion of value prepared by hand | Comparable closings, houses with houses and condos with condos, by Gia Freer |
| Estimated closing statement | Liens, costs of sale and commission, paid at closing as approved by the court |
How do you handle vacant or occupied property?
As the estate's property, documented for the file. On a vacant property we install a lockbox, photograph the condition on the first visit, confirm the utilities and tell the trustee what the insurance carrier should know about vacancy. On a condominium or in an association we request the estoppel early, because unpaid assessments are usually the largest surprise on a closing statement. On an occupied property we follow the trustee's direction on access and the existing leases, and we communicate with occupants respectfully and in writing.
Which bankruptcy divisions do you cover?
All three divisions of the Southern District of Florida for the five counties we serve.
| County of the property | Bankruptcy court division | Chapter 13 standing trustee |
|---|---|---|
| Miami-Dade | Miami | Nancy K. Neidich |
| Broward | Fort Lauderdale | Robin R. Weiner |
| Palm Beach | West Palm Beach | Robin R. Weiner |
| Martin | West Palm Beach | Robin R. Weiner |
| St. Lucie | West Palm Beach | Robin R. Weiner |

What experience backs this up?
Gia and Grant Freer have closed 767 transactions and $203,762,527 since 2000, 671 of them since 2013 (Beaches MLS, agent production report, as of October 19, 2026). PBP Real Estate has served South Florida since 2006. Gia and Grant earned the CDPE designation in 2012; Gia holds the National Association of REALTORS® SFR certification for short sales and foreclosures. Court-supervised sales are familiar ground: our probate work runs on the same kind of court timeline, with personal representatives, attorneys and judges in the file. See how we work with estate counsel on our page for probate attorneys.
Your file is handled by the Broker of Record herself, not passed to a junior agent. Debtors you send us can read plain-language explainers first: selling a house during Chapter 13, when a Chapter 7 trustee sells and selling after the case closes.
How do referrals work?
We never pay attorneys or trustees for referrals. Nothing of value changes hands for a referral or an employment, in either direction, and we do not split marketing costs with referral sources. What we offer is competence: a fast written opinion of value, clean paperwork and an honest offers log. Introduce us by phone or email with the property and the case posture, and Gia replies within one business day.

Have Gia review the property
Send the property and the case posture; a trustee's or attorney's office can start with an address. Gia Freer, our Broker of Record, reviews it personally and replies within one business day. No automated estimate is produced, and what you share stays confidential.

Tell Gia about the property in the case
Share what you know about the house or condo and where the case stands. Gia reviews it personally, replies within one business day, and keeps it confidential. Questions about the bankruptcy itself stay with your bankruptcy attorney.
Questions from trustees and attorneys
Will you sign a declaration in support of a sale motion?
Yes, about our own work: how the property was marketed, how long it was exposed, and the offers we received. Counsel prepares the declaration and the motion; we review the facts in it and sign our own statement. We do not draft court papers or anyone else's declaration.
Do you start work before the employment order is entered?
No. On an estate listing for a Chapter 7 trustee or a Chapter 11 debtor in possession, we supply the Rule 2014 statement and the proposed listing terms, and we start marketing after the court approves the employment. Before that we will answer questions about the property from public information, without charge and without obligation.
How is the commission set?
In the listing agreement, disclosed in the employment application or the sale motion, and paid at closing as approved by the court. We do not ask to be paid anything before closing.
Can the MLS listing say the sale is subject to court approval?
Yes, and on a bankruptcy sale it usually should. The listing says the sale is subject to court approval and includes the contingency counsel provides. It never names the debtor, the case or the reason for the sale.
Do you serve Spanish-speaking debtors and buyers?
Yes. Our office works in English and Spanish, and Ava, our phone assistant, answers calls in both languages around the clock.
