What a notice must contain

To be effective under 17 U.S.C. §512(c)(3), your written notice must include all of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorised to act on the owner's behalf.
  2. Identification of the copyrighted work you claim has been infringed.
  3. Identification of the material you claim is infringing, with enough detail for us to locate it — the full page address is best.
  4. Your address, telephone number and email address.
  5. A statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.

Please be aware that under 17 U.S.C. §512(f) a person who knowingly misrepresents that material is infringing may be liable for damages.

What we do when we receive a notice

We review each notice promptly and, where it appears valid, remove or disable access to the material and notify the person who supplied it. Material licensed to us through BeachesMLS is referred to the MLS and to the listing participant responsible for it.

Counter-notification

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notification to the agent above. It must include your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good faith belief the removal was a mistake or misidentification, your name, address and telephone number, and your consent to the jurisdiction of the federal district court for the district in which you live, or for the Southern District of Florida if you live outside the United States, together with your consent to accept service of process from the party who filed the original notice.

Repeat infringers

We terminate access, in appropriate circumstances, for anyone who is a repeat infringer.
