Who can sell a Miami-Dade property that is in probate

Until the court appoints a personal representative and issues letters of administration, nobody has authority to sign a listing agreement or a contract for the estate. That appointment happens in the Miami-Dade County probate division, and the attorney handling the estate is the person who tells you what your letters actually authorize.

What the letters say controls the sale. Some personal representatives hold a power of sale under the will and can contract without a further court order; others need court authorization, and some sales close only after the judge approves the contract. A brokerage cannot answer that question for you, and any agent who tells you it does not matter is telling you something expensive.

The sequence that keeps an estate sale from stalling

Estate files fail on paperwork far more often than on price. Before a property is marketed, the estate normally needs the letters of administration, the recorded deed history, the association estoppel and current fees if it is a condominium or a homeowners association property, insurance in force in the estate’s name, and a written answer on whether the homestead exemption and any portability apply after the owner’s death.

Two Florida-specific items catch families out. Homestead property can pass outside the estate to heirs by operation of law, which changes who signs; and property insurance often lapses or is non-renewed on a vacant house, which can end a contract days before closing. Both belong to the estate’s attorney and its insurance agent in writing, before anything is listed.

What the market evidence has to do with an estate decision

Miami-Dade single-family houses are at 5.3 months of supply with 4,201 active listings, and condominiums and townhouses are at 13.2 months with 11,203 active listings. Closed 2026 sales took a median 45 days on market for houses and 69 days for condominiums and townhouses.

For a personal representative those two numbers are a planning tool, not a price. A longer condominium marketing window means an estate holding a unit should budget carrying costs, association fees and insurance for that period, and should expect a buyer’s lender to ask about reserves and milestone inspections. Beneficiaries who are told a single blended county median are being given a number that describes neither property.

Often yes, but only once the court has appointed a personal representative and issued letters of administration, and only in the way those letters allow.
