Probate Property in Miami

This page is education, not legal advice. It explains what an estate sale in Miami actually turns on, what the dated market evidence means for a personal representative, and which questions belong to a Florida probate attorney or a tax professional rather than to a brokerage.

What an estate property in the City of Miami turns on

The City of Miami holds two different estate problems under one name. A condominium unit in the Brickell, Downtown or Edgewater corridor is sold through the association: the estate needs the estoppel, the current fee, the reserve funding schedule and any milestone inspection or special assessment paperwork before a buyer’s lender will move. A house in Coconut Grove, Allapattah or Flagami is sold on roof age, elevation, permit history and whether the structure can still be insured in the estate’s name.

The current split matters for planning: 1,959 houses are active at 5.2 months of supply against 4,788 condominiums and townhouses at 12.7 months, and closed 2026 sales took a median 43 days for houses and 64 days for condominiums and townhouses. An estate holding a unit should plan for the longer window and the carrying cost that comes with it.

Who can sell a Miami-Dade property that is in probate

Until the court appoints a personal representative and issues letters of administration, nobody has authority to sign a listing agreement or a contract for the estate. That appointment happens in the Miami-Dade County probate division, and the attorney handling the estate is the person who tells you what your letters actually authorize.

What the letters say controls the sale. Some personal representatives hold a power of sale under the will and can contract without a further court order; others need court authorization, and some sales close only after the judge approves the contract. A brokerage cannot answer that question for you, and any agent who tells you it does not matter is telling you something expensive.

The sequence that keeps an estate sale from stalling

Estate files fail on paperwork far more often than on price. Before a property is marketed, the estate normally needs the letters of administration, the recorded deed history, the association estoppel and current fees if it is a condominium or a homeowners association property, insurance in force in the estate’s name, and a written answer on whether the homestead exemption and any portability apply after the owner’s death.

Two Florida-specific items catch families out. Homestead property can pass outside the estate to heirs by operation of law, which changes who signs; and property insurance often lapses or is non-renewed on a vacant house, which can end a contract days before closing. Both belong to the estate’s attorney and its insurance agent in writing, before anything is listed.

What the market evidence has to do with an estate decision

Miami-Dade single-family houses are at 5.3 months of supply with 4,201 active listings, and condominiums and townhouses are at 13.2 months with 11,203 active listings. Closed 2026 sales took a median 45 days on market for houses and 69 days for condominiums and townhouses.

For a personal representative those two numbers are a planning tool, not a price. A longer condominium marketing window means an estate holding a unit should budget carrying costs, association fees and insurance for that period, and should expect a buyer’s lender to ask about reserves and milestone inspections. Beneficiaries who are told a single blended county median are being given a number that describes neither property.

Miami probate property: questions and answers

Who signs the listing agreement for an estate property in Miami?

The personal representative appointed by the Miami-Dade probate court, acting within the authority the letters of administration grant. Whether a further court order is needed before contracting, and whether the judge must approve the contract, depends on the will and the case. The estate’s Florida probate attorney answers that; a brokerage cannot.

What do Miami market conditions change about an estate sale?

Miami single-family houses are at 5.2 months of supply and closed 2026 sales took a median 43 days on market, while condominiums and townhouses are at 12.7 months and 64 days. That difference is a budgeting fact for the estate: taxes, insurance, association fees and maintenance run for the whole marketing period, and they run longer on a unit than on a house.

Does PBP give legal or tax advice on a Miami estate?

No. A Florida probate attorney answers appointment, homestead, creditor claim and court authorization questions, and a CPA or enrolled agent answers tax questions. PBP Real Estate is a licensed brokerage and publishes market data only.

Does PBP list probate properties in Miami?

Yes. PBP represents estate sellers directly in Miami-Dade, Palm Beach and Broward. A licensed PBP agent who handles probate sales in Miami works with the personal representative and the estate's attorney from the first call. PBP does not give legal advice.
