Short Sale vs Foreclosure in Florida

Short answer: a short sale is a sale you sign, at a price your lender approves, for less than what you owe. A Florida foreclosure is a lawsuit your lender files in circuit court that ends with the clerk auctioning the property.

The practical difference is control: in a short sale you choose the buyer, negotiate the shortfall and set a closing date; in a foreclosure the court calendar decides and the shortfall is decided for you. Bank owned, or REO, is not a third option — it is what the property becomes after the auction.

Both clocks run at the same time

The mistake that costs the most is waiting to see what happens. A Florida foreclosure case does not end your ownership when it is filed — the clerk’s sale does — so a short sale can usually still be negotiated after service, and lenders will sometimes postpone a sale date to let one close. But the sale has to be found, contracted, reviewed and approved before that date arrives, and market time is not negotiable.

Read those two columns as your calendar. Only 42% of houses and 29% of condominiums closed from a contract found within 30 days; 12% of houses took more than 180 days. And this describes homes that sold at all. Right now 31% of the 3,457 houses and 38% of the 5,288 condominiums on the market here have been listed more than 90 days. A homeowner who starts the month the first payment is missed has options; one who starts the week before a sale date usually does not.

What each path costs you in practice

In a short sale the lender approving the deal also approves the closing statement, so commission and standard seller closing costs normally come out of its proceeds rather than your pocket. Liens it did not agree to release — association dues, code enforcement, a second mortgage that will not sign off — still have to be resolved, and negotiating those is most of the work. In a foreclosure the court adds the lender’s costs and attorney fees to the judgment, and any surplus from the auction over the judgment belongs to you and has to be claimed through the court.

On credit, be skeptical of anyone quoting exact point damage. Both are serious derogatory events, the missed payments before either one do their own damage, and the number that actually matters to most people is the waiting period before they can finance a home again. Ask a mortgage lender what the current waiting period is for the program you would want; the guidelines have historically been shorter after a completed short sale than after a foreclosure, but they change.

What is the difference between a short sale and a foreclosure in Florida?

In one you choose the buyer, the price and the closing date subject to lender approval; in the other a court calendar sets them. Is a short sale or a foreclosure worse for my credit?

Both are serious derogatory events and neither is painless. Credit scoring models treat the missed payments that precede either one as their own damage, and mortgage underwriting guidelines have historically applied shorter waiting periods after a completed short sale than after a foreclosure. Ask a lender about current waiting periods for the loan program you would want next; do not decide from a general article.

Can I still owe money after a foreclosure in Florida?

Possibly. The unpaid balance after a sale is called the deficiency, and a Florida lender can ask the court for a deficiency judgment within the one-year period set by Florida Statutes section 95.11(5)(h). In a short sale the same shortfall is negotiable in the approval letter, which is why an explicit written release matters more than any other clause in it. What does bank owned or REO mean?

It means the foreclosure auction has already happened and the lender took the property back, so the bank is now the seller. Bank-owned is what a property becomes after the process ends, not an alternative to it. Once it is bank owned the former owner has no sale to negotiate and no proceeds to receive.

A contested judicial foreclosure commonly runs many months to more than a year from filing to the clerk's sale, and the summons gives you generally 20 calendar days from service to file a written response. A short sale typically takes three to six months from accepted contract to closing, plus marketing time in front of it. The two clocks run at the same time, which is why starting early is the only real advantage a homeowner has.

Can I do a short sale after the foreclosure case is filed?

Often yes. A filed case does not end your ownership; the clerk's sale does. Lenders regularly approve short sales while a case is pending, and the sale date can sometimes be postponed to let one close. What shrinks the option is time, so the file has to be complete and priced to sell.
