How Does a Short Sale Work in Palm Beach County?

Short answer: A short sale in Palm Beach County is a sale in which your lender agrees to accept less than the full mortgage balance and release the lien so the closing can happen — and because Florida is a judicial foreclosure state, you usually have months of court process in which to arrange one.

When a short sale is the right answer — and when it is not

The first question is not how a short sale works. It is whether you need one. A short sale only applies if you owe more than the property is worth. Palm Beach County values have risen substantially over the past decade, and a large number of owners who are behind on payments are not underwater at all — they are ordinary sellers with real equity to protect. If that is you, a short sale would be the wrong instrument entirely, and it would cost you the equity a normal sale would put in your pocket.

So the sequence is always the same: establish the value, then compare it with the payoff, and only then choose the tool. Getting that order wrong is the single most expensive mistake we see.

The process, step by step

  1. Establish the value and the payoff. A written opinion of value from current BeachesMLS evidence, and a current payoff figure from every lienholder — first mortgage, any second, HOA arrears, judgments, tax liens. The gap between those two numbers is the whole case.
  2. Assemble the lender package. Servicers ask for a hardship letter, recent pay stubs or profit-and-loss statements, bank statements, tax returns, a financial worksheet and a signed listing agreement. Incomplete packages are the main reason short sales stall, so it goes in complete or it does not go in.
  3. List and market the property properly. A short sale still has to attract a real buyer at a defensible price. Lenders test the price against their own valuation, so a property marketed badly and sold cheaply is more likely to be rejected, not less.
  4. Submit the contract for lender approval. Once a buyer is under contract, the executed contract and the closing statement go to the servicer’s loss-mitigation department for review.
  5. Lender valuation and negotiation. The lender orders its own appraisal or broker price opinion. If it disagrees with the price, the negotiation happens here — with evidence, not opinion.
  6. Approval letter, then closing. The approval letter states the minimum net the lender will accept, the expiry date, what it will pay in costs, and — critically — whether it releases you from the shortfall.

The deficiency waiver is the clause that matters

The shortfall between the sale proceeds and the loan balance is called the deficiency. An approval letter that clears the lien but stays silent on the deficiency can leave the balance pursuable afterwards. Getting an explicit release in writing is the single most valuable thing a negotiator does on a short sale, and it is worth more than a few thousand dollars of price. Whether a released balance creates taxable income is a question for your CPA, not for us.

Who pays the costs in a short sale

In practice the lender absorbs most of the seller-side costs out of the proceeds it accepts, because the alternative is a foreclosure that costs it more. That customarily includes the real-estate commission, documentary stamps on the deed and, in this county, the owner’s title insurance policy that a Palm Beach County seller would normally pay for. When a lender files a foreclosure suit it records a lis pendens with the county clerk, and that is a public record. Expect letters and calls from investors and cash-offer operators within days. Some are legitimate. What they have in common is that the offer is priced against your deadline rather than against a reading of your property, and the only way to judge one is to know what the property is worth first. Nobody needs your signature today. Know the value before you respond to any of them, and never sign over a deed to solve a payment problem without a lawyer reading it first.
