Florida requires structural milestone inspections and structural integrity reserve studies for older condominium buildings of three stories or more, and requires associations to fund the reserves those studies identify. Whether and when that applies to your building is a question for the association and, where money turns on it, an attorney. What the feed shows is the exposure: 506 of the 548 condominiums on the market in this city are in buildings from 1996 or earlier, and the median age-restricted building dates from 1977.

An assessment is a fixed sum per unit. The same concrete work that is absorbed by a $600,000 property can exceed the entire equity in a $104,000 one, and a cash buyer — which is 86% of this market — deducts it from their offer in full rather than folding it into a loan. That is the specific route into negative equity in Deerfield Beach, and it has nothing to do with missed mortgage payments.

So before we price a unit in an older building here we ask for the association's most recent financial statement and reserve schedule, and the written balance of what you personally still owe on any assessment. We pull the building's own closing history out of the feed at the same time, because a building where nothing has closed this year is telling you something the comparable sales will not.

A fifth of condominium sales here run past six months and finish 18.5% below their original asking price. Put a servicer's review on top of that and an approval letter written in month two can expire before the unit closes. In a short sale the sequencing is the whole job: the price has to be right the first time, because there is no cheap second attempt.

The order that protects you never changes. Get a written payoff from every lienholder, association included. Get a written opinion of value set against it. Only then decide whether this is an ordinary sale with equity in it or a short sale needing lender approval.

Yes, and here it usually happens through the association rather than the mortgage. Age-restricted units in this city closed at a median $104,000 in buildings whose median year built is 1977. A special assessment for structural work is a fixed sum per unit and does not shrink to match a low-priced property, so a five-figure assessment can be a large share of the entire value. What is owed to the association is cleared at closing alongside the mortgage, which is where the shortfall appears.

Does the cash buyer market help or hurt a short sale here?

Both. 86% of buyers in the age-restricted communities pay cash, which means no appraisal contingency and no lender delay on the buyer's side, so a file can move quickly once it is priced right. The hurt is that cash buyers price known assessments straight out of their offer, so the number reaching your lender is lower than an owner expects. That is manageable if the association's figures are in the file from the start rather than discovered during review.

How long does a Deerfield Beach short sale take?

The median condominium takes 75 days to go under contract and age-restricted units 92, before the servicer's one to three months of review. 21% of condominium sales take more than 180 days. A lender's approval letter can expire before a slow unit reaches closing, which is the most common way these files fail, and re-approval is harder than the first approval was.

Am I actually underwater, or does it just feel that way?

If you own a house here there is a fair chance you are not. Houses closed at a median $535,000 with only 3.1 months of supply, and the house market is orderly: sales that took more than 180 days still closed only 7.1% below their original asking price. The only way to know is a written opinion of value set against a current written payoff from every lienholder, the association included, in that order.

Will I owe the shortfall after the sale?

Only if the approval letter leaves it pursuable. The shortfall is called the deficiency, and an approval letter that releases the lien while saying nothing about the deficiency can leave the balance collectable afterward. An explicit written release is the most valuable single item in the negotiation. Whether a released balance is taxable is a question for your CPA, not for us.

Can I still sell after the foreclosure case has started?

Usually yes. In Florida the case runs through the courts, and until the clerk's sale is held and title transfers, the owner generally still holds title and can sell. That leaves you a deadline rather than a door already shut.
